The state’s simplified divorce process is available to spouses who want to split without blaming each other and who can agree on their own as to how their property will be divided. The simplified process thus gives spouses the chance to go their separate ways without a drawn-out courtroom battle.

To qualify for a simplified divorce in Florida, a couple needs to meet some basic requirements. They need to prove that at least one of the spouses has been living in the state for the six months leading up to the filing of the divorce petition. They also must agree that the marriage is “irretrievably broken.” This is a catch-all term that does not require spouses to point fingers at each other or prove that one is to blame for the split. A couple seeking a simplified divorce also needs to show that they do not have any children under 18, that neither spouse is seeking alimony from the other, and that they have agreed about how they will divide all of their property and debt.

Even if you do not qualify for the simplified process, a couple can avoid many of the complications that come with divorce cases by agreeing how they will resolve issues like child custody and support as well as property division. A couple has the power to make these decisions by themselves, rather than leaving them up to a judge. In fact, you can even make some of those decisions before you get married by entering into a prenuptial agreement. These agreements must be in writing, in addition to meeting certain other requirements, in order to be enforceable under Florida law.
