Using the Mediation Process

Although many divorce cases wind their way through the Florida courts, we have found that the overwhelming majority of family law matters can be resolved through settlement or mediation. The latter option is a particularly attractive alternative to traditional divorce litigation. Mediation allows divorcing spouses to avoid much of the legal system by instead taking their case to a neutral third party called a “mediator,” who is trained to help resolve any and all outstanding issues. These include questions about property distribution as well as child and spousal support, among others. The mediator works with the divorcing spouses to reach a settlement on these and other issues that is then finalized in writing and can be enforced through the courts if necessary. A divorce mediation attorney can help Miami residents make sure that their interests are appropriately represented during mediation.

Divorcing couples in Florida have the power to use mediation to resolve their differences. In some cases, a court may also order spouses to try mediation as a way to settle some or all of the issues at stake. In either circumstance, the mediator should be certified by the state Supreme Court. The law requires mediators to remain neutral at all times in the process, to work for the spouses’ mutual benefit, and to refrain from forcing either spouse to agree to a settlement. Mediation is generally considered a cheaper and less time-consuming process than traditional litigation because the emphasis is on coming up with a mutually agreeable solution for divorcing couples. The spouses themselves often have a greater voice in the ultimate agreement, rather than having it imposed upon them by a judge.
