Simplified Process in No-Fault Divorce Cases

Divorce cases can be complicated, stressful, and costly situations, but that does not mean they have to be. Florida is a “no-fault” divorce state. This means that either spouse in a marriage can get a divorce by simply stating that the marriage is “irretrievably broken.” In other words, spouses who want to get a divorce do not need to waste time and energy arguing over who is to blame for the split. This is one of a number of ways in which the state legal system tries to make it easier for spouses to divorce in an amicable, or at least mutually acceptable, way.

In many cases, a person seeking a no-fault divorce can have the matter resolved in a simplified legal procedure that speeds up the process. The spouses must file jointly for a simplified marriage dissolution. They also need to show that they meet all of the legal requirements for the simplified process. These include proving that one spouse has lived in the state for at least the six months leading up to the divorce and that the spouses agree that the marriage is irretrievably broken. They also must confirm that they do not have children under the age of 18, that neither spouse is seeking alimony from the other spouse, and that they have agreed as to how they will divide all of their property and debt.

When Fault Might Matter

Spouses who do not meet these requirements can start contested divorce proceedings when one of them files a standard petition of dissolution. These cases can also often be resolved in a collaborative and efficient manner. In some instances, however, it will be up to a judge to decide who gets custody of the kids, how certain property is divided, and whether either spouse is entitled to financial support from the other. In these situations, a court has the power to consider whether one spouse is actually at fault for the divorce. For example, if one spouse has been squandering the family’s money and assets, a judge may take that into account in dividing property and awarding support.
